This Policy describes how EverCore Digital Systems Ltda., operator of the EverClose Log platform, processes personal data of drivers who use, access or are monitored within logistics operations carried out through the platform.
This policy applies to drivers linked to carriers, self-employed drivers, aggregated drivers and other professionals involved in logistics operations recorded in EverClose Log.
1. Who Is the Data Subject
For the purposes of this Policy, the data subject is the driver whose personal data is processed by the platform, including when linked to a carrier, logistics operator, shipper, or contracting party of the operation.
2. Data That May Be Collected
Depending on the operational context, the platform may process the following data:
2.1 Registration data
- name
- phone number
- CPF, when applicable
- professional identification data
- link to carrier or operation
2.2 Location and movement data
- real-time location
- route history
- travel speed and direction
- start, stop, and end times of the trip
- movement, stop, delay, or route deviation events
2.3 Operational data
- shipments linked to the driver
- delivery history
- logistics incidents
- pickup, delivery, and checkpoint records
- operational evidence such as photos, confirmations, and check-ins
2.4 Technical and usage data
- device identifiers
- access logs
- application version
- technical records required for security, support, and auditing
3. Use of the driver's own device
When the driver uses a personal mobile device to access EverClose Log, the platform will collect only the data necessary to execute the logistics operation and the features actually used.
EverClose Log does not access personal content on the device, such as messages, contacts, private photos, personal files, or information from other applications unrelated to the logistics operation.
4. Purposes of Processing
Data may be processed for the following purposes:
- execution and monitoring of logistics operations
- real-time shipment tracking
- ETA calculation and operational forecasts
- generation of operational evidence and audit trails
- cargo, route, and operation security
- fraud and inconsistency prevention
- recording and handling of logistics incidents
- improvement of platform performance, stability, and security
- compliance with legal, regulatory, and contractual obligations
- support for the generation of logistics performance indicators, including operational and reputational history, when applicable
5. Applicable Legal Bases
Data processing may occur based on one or more of the following legal grounds, depending on the case:
- performance of a contract
- compliance with a legal or regulatory obligation
- legitimate interest
- regular exercise of rights
- consent, when legally applicable or adopted within the application flow
6. Tracking and Consent in the Application
The driver acknowledges that certain logistics operations may require location tracking during execution.
Location collection occurs primarily during the execution of logistics operations linked to loads, routes, deliveries, pickups, checkpoints, geofences, or active operational events on the platform. This processing is not intended for continuous personal monitoring of the driver outside the operational context.
Where applicable, consent may be requested directly in the application in a specific, prominent manner appropriate to applicable law. When processing is based on another legal basis provided by the LGPD, such as performance of a contract, legitimate interest, compliance with a legal obligation, or regular exercise of rights, processing may occur independently of consent, while respecting the data subject's rights.
Whenever technically possible, the application will inform the driver when location resources are active for operational purposes.
Refusal to grant consent or location permission may impact essential features related to tracking, shipment monitoring, operational proof, and execution of certain operation stages.
7. Data Sharing
Processed data may be shared, when necessary and within the limits of the stated purpose, with:
- carriers
- shippers
- logistics operators
- clients contracting the platform
- authorized users within the context of the operation
- technology providers and partners
- public authorities, regulatory bodies, or courts, when there is a legal obligation or valid request
8. Use for Operational Evidence and Audit
Location data, operational events, documents, and records related to the execution of the operation may be used as operational evidence, audit trail, proof of logistics stages, support for service, and defense of rights in administrative, arbitration, or judicial proceedings.
9. Logistics Performance Indicators
Certain operational data may be used to compose logistics performance indicators, operational history, and metrics related to execution quality, provided the legitimate purposes of the platform and the principles of the LGPD are observed.
These indicators are operational and analytical support tools and do not represent an absolute guarantee of future performance.
10. Data Retention
Data may be stored for the period necessary for:
- performance of contracted services
- compliance with legal and regulatory obligations
- audit and compliance
- regular exercise of rights
- preservation of legitimate operational history
Whenever possible and applicable, data may be deleted, anonymized, or aggregated after the required retention period ends.
11. Information Security
EverCore adopts reasonable technical and administrative measures compatible with the nature of the platform to protect data against unauthorized access, loss, destruction, alteration, leakage, or any unlawful or improper processing.
12. Data Subject Rights
Under applicable law, the driver may request, when applicable:
- confirmation of the existence of processing
- access to data
- correction of incomplete, inaccurate, or outdated data
- anonymization, blocking, or deletion, when applicable
- information about data sharing
- withdrawal of consent, when consent is the applicable legal basis
13. Important Limitations
The processing of the data described in this Policy occurs in the context of logistics operations and may be necessary for the proper execution of the services contracted by the platform's clients.
Due to the operational nature of the service, some features depend on the processing of location data, events, and operational records.
Refusal or withdrawal of permissions may prevent or limit operational tracking, delivery confirmation, pickup proof, checkpoint registration, photographic evidence, incident communication, or execution of stages linked to the load.
Dependence on these permissions does not authorize unrestricted, permanent, or purpose-incompatible collection. Processing must remain limited to the data necessary for the logistics operation, subject to applicable legal bases, data subject rights, and available technical settings.
14. Updates to This Policy
This Policy may be updated at any time to reflect operational improvements, regulatory changes, or the evolution of platform services.
